By clicking the box agreeing to the Terms of Use and Privacy Policy, user hereby acknowledges that user agrees to all terms and conditions as provided in the Terms of Use and Privacy Policy with respect to the download and use of mobile app “Takashimaya Việt Nam” hoặc “Takashimaya VN” (“Mobile App”). If you do not agree with the Terms of Use and Privacy Policy, please do not download or sign up for this mobile app, or not use our website. User also concedes that the Terms of Use and Privacy Policy form an integrated agreement between the user and Takashimaya Vietnam Ltd. (“Agreement”).
References in these Terms of Use to “Takashimaya” or “we” or “our” or “us” refers to Takashimaya Vietnam Ltd., a company duly established and operated under Enterprise Registration Certificate No. 0312505165 issued for the first time on 13 September, 2013 and subsequently amended 04 February, 2016, and under Investment Registration Certificate No. 8746548326, first amended on 06 April 2016 by the Department of Planning and Investment of Ho Chi Minh City; owner to manage and operate Takashimaya Department Store (D.S.), located at 92-94 Nam Ky Khoi Nghia, Ben Nghe Ward, District 1, Ho Chi Minh City, Vietnam.
The Mobile App/Website allows the user to be a Member of Takashimaya D.S. – confirmed in accordance with the Member Rules – and access Takashimaya’s data in order to
(i) update and change Member’s profile,
(ii) accumulate and review bonus points and shopping history,
(iii) receive information of goods/services, promotion programs or other entertainments to be available at Takashimaya D.S, and
(iv) communication channel to advertise to Takashimaya D.S.
Any customer who is not a Takashimaya Member may at anytime become a Member of Takashimaya by registering as set forth in Section 3 below or directly contacting the Customer Servicer Counter, Level 3 Takashimaya Department Store.
At the time of launch, this Mobille App/Website does not have a function to shop online or communicate online. Any customers who wish to shop should visit a Takashimaya Department Store to pick up the items or directly contact us to get more information.
This Mobile App/Website is only applied and available within the territory of Vietnam and may be used by Takashimaya’s Members in Vietnam. We reject any complaint sent to us by user if the sender is not satisfied with the Member Rules.
At anytime, users who have consistently satisfied the conditions in the Member Rules, may, at their discretion, sign up to become a Member using the following methods of registration:
Method 1: Directly register at the Customer Service Counter, Level 3 Takashimaya Department Store;
Method 2: Sign up by downloading and using the mobile app Takashimaya Việt Nam or Takashimaya VN; or
Method 3: Create a Member’s account on the website: www.takashimaya-vn.com.vn
a) We may revise these Terms of Use at anytime by amending this page. Please check this page from time to time to take notice of any changes we have made, as they are binding on you. We may update our Mobile App/Website from time to time, and we may change the content at any time. However, please note that any of the content on our Mobile App/Website may be out of date at any given time, and we are under no obligation to update it.
(b) Access to our Mobile App/Website is made available free of charge. We do not guarantee that our Mobile App/Website, or any content on it, will always be available or uninterrupted. We may, for any reason, suspend, withdraw, discontinue or change all, or any part of, the content of our Mobile App/Website.
(a) The copyright in our Mobile App/Website is owned by us or its licensors.
(b) No part or parts hereof may be reproduced, distributed, adapted, modified, republished, displayed, broadcast, hyperlinked, framed or transmitted in any manner or by any means, or stored in an information retrieval system, without our prior written permission.
(c) Any information, text, images, links, sound, graphics and video displayed on our Mobile App/Website is owned by us or our Retailers who have granted us the right of use. Therefore, you are not permitted to download or print any information, text, images, links, sound, graphics or video displayed on this Mobile App/Website. You also may not, without our permission, insert a link to our Mobile App/Website on any other Mobile App/Website or mirror any material contained on our Mobile App/Website on any other server.
(a) The trademark, service marks (if any) and logo, including text and image of Takashimaya, image of Rose-chan and the variant forms of Rose-chan (“Trademarks”), used and displayed on this Mobile App/Website are registered to Takashimaya and Takashimaya Group or its licensors.
(b) Nothing on our Mobile App/Website may be construed as granting, by implication, estoppel or otherwise, any license or right to use any of the Trademarks displayed on our website, without receiving the written permission of Takashimaya.
(c) Takashimaya and its affiliates and subsidiaries (if any) enforce their intellectual property rights to the fullest extent of the laws of Vietnam, Japan and relevant international conventions. The name “Takashimaya”, “Ho Chi Minh City Takashimaya”, “Takashimaya Department Store”, “Rose-chan”, “Rose-chan Doll” and the Trademarks may not be used in any way, including advertising or publicity pertaining to the distribution of materials on our mobile app/website, without the prior written permission of Takashimaya.
(d) Takashimaya prohibits the use of the Trademarks as a web link or hyperlink to any Takashimaya site or any other site unless the establishment of such a link is approved in advance by Takashimaya in writing.
(a) Our Privacy Policy explains how we treat and protect your personally identifiable information (“Personal Information”) when you our Mobile App/Website. Please refer to the terms and conditions of our Privacy Policy which are expressly incorporated into these Terms of Use.
(b) We may share your personal data with and among other affiliates and subsidiaries (if any), or with any third party provided that has been agreed by you and regardless of your consent, we may share your personal data with the relevant governmental and/or regulatory authorities, whether in Vietnam or abroad for the aforementioned purposes.
(c) We may share anonymous or aggregate information among our affiliates and subsidiaries (if any) and with third parties. Aggregate or anonymous information does not contain any personal data, and accordingly its use and disclosure is not subject to the terms of this Policy.
(a) Through the Mobile App/Website, we offer a brand name search of retailers listed on our website (the “Retailer”). Please check the website for details about available brand names.
(b) The Mobile App/Website allows you to browse a range of products from different Retailers. If you need further information or decide to make a purchase, please visit our department store at 92-94 Nam Ky Khoi Nghia, Ben Nghe Ward, District 1, HCMC or click on the hyperlink to Retailer’s website as provided in each brand name listed on our website. Takashimaya is not responsible for the accuracy of any statement or advice contained in the text or advertisements. All prices are provided by the Retailer. You should review the Retailer’s website for the most accurate information about price and availability. If you would like further information, we recommend that you call our Customer Service: 02838211819 or directly call Retailer’s shop located at Takashimaya Department Store.
From time to time, the goods change/return policy may be amended and updated in conformity with our business demand and the goods change/return policy of each Retailer. Therefore, we publish all necessary information as well as the goods change/return policy applicable to all customers within Takashimaya Department Store at the effective time.
We offer a free-of-charge delivery service for goods/products purchased within Takashimaya Department Store if the total value of invoices issued by Takashimaya to our customers is higher than VND 5 million and the delivery point is within Ho Chi Minh City, excluding districts 9, 12, Thu Duc, Binh Tan, Binh Chanh, Nha Be and Hoc Mon. For invoices with a value higher than VND 8 million, delivery is available for points within districts 9, 12, Thu Duc, Binh Tan, Binh Chanh, Nha Be and Hoc Mon. We may revise or update the delivery policy at any time by publicly notifying and amending this term. We do not accept any ordering online or by phone. If at anytime Member needs to contact us, please directly contact the Customer Service Counter, Level 3 of Takashimaya Department Store.
We welcome your feedback regarding our Mobile App/Website and services. We do not, however, accept confidential or proprietary information. No feedback, suggestions, ideas, materials, information and other submissions disclosed, submitted or offered to Takashimaya (collectively, “Submissions”) are non-confidential and will become and remain our property. Takashimaya will not be liable for any use or disclosure of any Submissions. Submissions by you must not violate any right of any third party and must not contain any libelous, abusive, obscene or otherwise unlawful material.
(a) Limitation of our liability Takashimaya disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of satisfactory quality, merchantability or fitness for a particular purpose, compliance with description or the warranty of non-infringement.
(b) We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable or arising under or in connection with:
(i) any system, server or connection failure, error, omission, interruption, delay in transmission, ,or computer virus;
(ii) any access, use or the inability to access or use our website, or reliance on the materials and/or any information in our website;
(ii) any access, use or the inability to access or use our Mobile App/Website, or reliance on the materials or any information in our Mobile App/Website; or
(iii) any use of or access to any other app/website linked to our app/website.
(c) Any hyperlink to any other Mobile App/Website is not an endorsement or verification of such Mobile App/Website, and such websites should only be accessed at your own risk. This exclusion clause takes effect to the fullest extent permitted by law.
While certain precautions have been taken to detect computer viruses and ensure security, Takashimaya cannot guarantee that the Mobile App/Website is virus-free and secure. Takashimaya will not be liable for any loss or damage that occurs as a result of any virus or breach of security. Takashimaya does not give any warranties as to the compatibility of the Mobile App/Website with your mobile systems, software or hardware.
If you use the Mobile App/Website in any way that results in damage to Takashimaya, you must take responsibility for such damage. You agree to indemnify Takashimaya and our officers, employees and licensors from and against any and all losses as a result of your access to or use of the Mobile App or breach of these Terms of Use.
(a) These Terms of Use shall be governed and construed in accordance with the laws of the Socialist Republic of Vietnam.
(b) If any part of these Terms of Use is determined to be invalid or unenforceable under applicable law, the invalid or unenforceable provisions will be deemed superseded by valid, enforceable provisions that most closely match the intent of the original provisions, and the remainder of these Terms of Use will continue in effect.
(c) Any disputes arising out of, in respect of, or in connection with these Terms of Use shall be settled by the competent courts of Vietnam.
