  16. WHAT WE COLLECT
    1.1 We may collect your personal information in the process of accessing or purchasing our products by you on our Mobile App. To be clear, “Personal Data” or “personal data” hereby is defined as any information, whether accurate or not, relating to an identified or identifiable natural person. The collection of your personal information shall be made in accordance with this Privacy Policy & Information protection and as permitted by applicable data protection laws of Vietnam. Therefore,
    (a) “Personal data” means and refers to personal information associated with the identification of a particular person (hereinafter referred to as “Personal Data”). Depending on Personal Data provided to us, Personal Data may include information but is not limited to:
    (i) Name; age; the number of ID card (identification card) or passport;
    (ii) Gender; date of birth; photographs; voice recordings; images from closed-circuit television (CCTV); and
    (iii) Postal address; email address; telephone number and mobile phone number; and
    (iv) Address, contact information, delivery information; and
    (v) Bank account and relevant information for payment when you have a transaction with us;
    (vi) Aggregated data about the content you used.
    (b) If at any time you would like to give us any feedback or any other suggestions, we may request that you give us one or all items of information outlined in Article 1(a) above.
    (c) Additionally, for the purpose of the best service for you, Takashimaya, from time to time, may request you to provide some other information voluntarily and in accordance with the law.

1.2 In the event that you register an account to become a Member by using a social network account (“Social Network Account”), or other links to Takashimaya Social Network Account or using any other social media feature of Takashimaya, we reserve the right to access your information that you have voluntarily provided to Social Media Account service provider in accordance with policies of that service provider.

  1. PURPOSE OF PERSONAL DATA WE COLLECT
    The Personal Data you provide helps us to understand your needs, maintain our relationship with you, process transactions (if any), fulfil our delivery obligations for any products, services or activities we undertake with you, and improve the quality of our services. In particular, we collect your Personal Data for the following purposes, including without limitation:
    (i) Orders: to process relevant information for the provision of products, services or activities that best meet your preferences or needs;
    (ii) To respond to the feedback, requests, complaint from you;
    (iii) To provide information relating to promotional programs and loyalty programs; marketing products or other trade promotion programs of Takashimaya to you;
    (iv) To maintain your account in the Mobile App;
    (v) To communicate with you and/or contact for sending notifications, or letters to you;
    (vi) To provide such information to our business partners who are our service providers in relation to orders, limited only to providing the necessary information as well as ensuring the security of private information. We may use services provided by a service provider as a third party to implement one or more services in relation to activities of Takashimaya, and such third party might access or handle this private information in the execution and provision of this service;
    (vii) To evaluate the use, and improve the quality of goods on the Takashimaya’s Mobile App;
    (viii) To prevent fraudulent activities, impersonating customers;
    (ix) To do market research and prepare analysis reports: Takashimaya may use your Personal Data for market research and consumer behavior analysis. Specific information shall be hidden and we are committed to using these analyzes/reports only for statistical purposes.
    (x) Depending on the applicable law from time to time, we may collect, store and provide Personal Data at the request of competent authorities.
    (xi) In addition to the above purposes, Takashimaya may collect, use, disclose or process your Personal Data for other purposes depending on the actual circumstances. Furthermore, Takashimaya shall notify you of the use purpose at that time and obtain your consent, except for the case of use without the permission in accordance with the applicable law.
  2. CONSENT AND WITHDRAWAL OF CONSENT
    (a) Your Personal Data shall only be collected in cases where you express your consent for the purposes, uses, and disclosure set out above. There will also be instances where your consent for the collection or use of your Personal Data will necessarily be implied from the circumstances surrounding the nature of the task or transaction, including your interaction with us or when providing any of our products, services or other activities you have requested.
    (b) In cases where you are supplying Personal Data of another individual (e.g., information of your spouse, children, parents, and/or your employees), you represent and undertake the responsibility to ensure, that the individual whose Personal Data is supplied to us has consented to provide us with his or her Personal Data for the respective purposes and is informed of and consents to the terms of this Privacy Policy & Information protection.
    (c) This Privacy Policy & Information protection shall supplement any other policies that you may have previously consented to provide to us in respect of your Personal Data.
    (d) If you do not want us to collect your Personal Data, you may opt-out at any time by notifying us in writing according to the information in Section 15. DATA CONTROLLER’S CONTACT AND HELPFUL INFORMATION below.
  3. SCOPE OF COLLECTION
    We may collect your Personal Data through forms and in accordance with applicable law. Here are the sources from which we gather your information:
    (a) The information which you directly give us;
    (b) Information which you register our account or use our service on Mobile App;
    (c) Information which you provide to us in any forms, including but not limited to register form, or other relevant forms relating to any of our products, or services;
    (d) Automatic information is automatically obtained by our system when you interact with our Mobile App;
    (e) Information which you provide the response or complaint to Takashimaya;
    (f) Information about you from other legitimate sources.
  4. ACCESS, UPDATE, CHANGE, CANCELLATION OF PERSONAL DATA OR COMPLAIN ABOUT THE USE OF PERSONAL DATA
    (a) You may, at any time, update, change or cancel your Personal Data or complain about the use of personal data (in connection with the misuse of personal information; purpose or other than the notified scope and other relevant circumstances) by:
    (i) signing in to your Member’s account through the Mobile App or Website and proceed to update, change some information. Other information cannot be changed by accessing the App, Customer can use method (ii) and method (iii) listed below to request access, update, change, cancel the personal data and complaints; or
    (ii) directly contacting Customer Service Counter, Basement 1 of Takashimaya Department Store; or
    (iii) calling, complain our Hotline: 0911513348.
    (b) For data processing requests, we will respond within 72 hours or any other timeframe required by applicable law, whichever is longer.
    (c) Depending on the scope of your request, you may not be able to receive from us any updates on product information or promotions and will be updated, changed, or canceled personal data, but in some special cases, your Personal Data may continue to be used and disclosed for other purposes, such as the processing of transactions you have engaged in with us or as requested by the authorities or otherwise permitted by law.
  5. ACCURACY
    (a) You should ensure that all Personal Data submitted to us is current, complete and accurate. Failure on your part to do so may result in our inability to provide you with the products and/or services you have requested.
    (b) If you believe that any Personal Data we are holding with respect to you is incorrect or incomplete, please notify to our Customer Service Officer.
  6. COMMITMENT TO PERSONAL DATA PROTECTION
    • We are committed to ensuring the security and protection of your Personal Data in our possession and control by making reasonable security arrangements to prevent illegal access, collection, use, disclosure, copying, modification, disposal and other similar risks.
    • Takashimaya commits not to sell or share Personal Data that leads to the disclosure of your information without your consent, except as required by law or competent authorities or under set forth in this Privacy Policy & Information protection.
    • Takashimaya commits not to force you to use the accompanying services when using or installing the Mobile App.
    • Takashimaya uses suitable security system to encrypt all information entered by you to keep it secure.
    • For the purpose of working together with Takashimaya to secure your Personal Data, you are responsible for protecting your own payment, and delivery information to any other third party to avoid information disclosure. In the event that information is leaked due to your fault, Takashimaya shall not be responsible for any problems arising.

We always try our best to protect your Personal Data. In case of any complaints, requests or suggestions, please immediately contact us to notify and jointly handle them through the methods listed in Section 15. Please note that, by this Privacy Policy & Information protection, we do not guarantee the security of Personal Data and/or other information you provide on the platform of other third parties.

  1. PAYMENT SECURITY
    The payment system on the Mobile App is provided by payment gateway partners that have been officially licensed to operate in Vietnam, connecting with the system of domestic and international banks. Accordingly, the payment security standards of the Mobile App ensure compliance with the security standards of the payment gateway partners.
    Takashimaya does not directly store your information. The information security of your payment card is performed by licensed payment gateway partners. Takashimaya commits to strictly implementing necessary security measures for all payment activities performed on the Mobile Application.

The transaction policy for international and domestic cards (internet banking) payment ensures compliance with the security standards of payment gateway partners, including:
• SSL (Secure Sockets Layer) internet data security standard issued by GlobalSign.
• Payment information security standard (PCI DSS) certificate issued by Trustwave.
• 128-bit MD5 encryption standard.
• One-time password (OTP) is sent via SMS to ensure the account access is authenticated.
• Principles and regulations on information security for the banking and finance industry in accordance with the law and the State Bank of Vietnam.

  1. INDIVIDUALS/ORGANIZATIONS WITH THE RIGHT TO ACCESS PERSONAL DATA
    9.1. We shall not provide your personal information to any third parties, except for some necessary activities as follows:
    (a) Sharing to our Subsidiaries, Affiliates for the purpose of using information that has been authorized by the Customer;
    (b) Sharing with partners who are suppliers of goods/services of Takashimaya related to the fulfillment of orders for you and sharing information shall be limited to the necessary information as well as the application of protection regulations, to ensure security and confidentiality of Personal Data;
    (c) We may use services from a third-party service provider to perform certain activities related to Mobile App and then this third party may access or process your Personal Data in the process of providing services to us.
    (d) Disclosing information that is Takashimaya’s legal obligation required by a competent authority, and is reasonably necessary to comply with legal requirements;
    (e) In the event of a business transfer (such as a merger, or consolidation, whether in whole or in part), the transferred company shall also have the right to access the information we have stored and maintained including your personal information.

9.2. For those cases where we have the right to use, process, disclose and/or transfer your personal data to third-party service providers, agents and/or affiliated companies or our related company, and/or other third parties who may be located in Vietnam or outside Vietnam, this use, transfer, and disclosure will be made in accordance with the procedures and regulations of current law.

  1. USER’S RIGHT
    You, at any time in process of using the Mobile App, have the rights as below:
    (a) Give us the consent for accessing, and processing your Personal Data and withdraw your consent at any time;
    (b) Provide us with your Personal Data and change your decision any time;
    (c) Check, update, correct or delete the information you provided us.
  2. USE OF COOKIES
    Our Mobile App does not capture Personal Data regarding your online use unless you choose to access or use our Mobile App or provide such information to us. By browsing or using our Mobile App, you consent to and allow our use of cookies to collect information on your Mobile App usage data and improve your online experience when browsing or transacting using our Mobile App. A cookie is a small file placed on your computer’s hard drive that helps to analyze Mobile App traffic or let you know when you visit a particular site, and it can include information about the way you use a Mobile App, your choice of Mobile App browsers, the type of devices you are accessing it from, and where you are in the world. In particular:

(a) Cookies allow mobile applications to process their operations to your demands, likes, and dislikes by gathering and remembering information about your preferences, but a cookie does not give us access to your computer or use of any information about you other than the data you choose to share with us; and

(b) Traffic log cookies enable us to identify what pages are being frequently used and help us to analyze data about mobile page traffic to tailor services to your needs. Such information is used for statistical analysis, and the data is removed from the system thereafter. You can choose to accept or decline cookies in the course of browsing a Mobile app. Most Mobile App browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies if you prefer. However, this may prevent you from taking full advantage of our Mobile App.

  1. USE OF GOOGLE ANALYTICS
    For the purpose of exchange of your information with advertising partners, we may use Mobile application analysis services, or customer behavior tracking systems provided by third parties (such as Google Analytics) which use cookies and other similar technologies to collect information about websites or application usage and report on usage trends (but this tools will not identify customers). These tools might collect your information such as age, gender, interests, and number of interactions with displayed ads. These third parties may provide us with information about your visit to other Mobile Apps. With ad settings, you can opt out of accessing the Google Analytics used by downloading the “Google Analytics Opt-out Browser Add-on” at this Link.
  2. RETENTION
    We retain your Personal Data for as long as it is needed to meet the collection purposes described herein in accordance with the provisions of the law on the protection of privacy of personal information and/or other applicable laws. We undertake to anonymize, stop retaining or delete your Personal Data as it is no longer required by regulation or in case that Personal Data is inconsistent with our business purposes or as your request, except where further storage is necessary in the individual case to comply with our legal obligations (such as specific data retention obligations) or to establish, exercise or defend our legal claims. When such information is no longer necessary for the aforementioned purposes, we may delete or retain it in the form without identifying specific customers.
  3. GOVERNING LAW AND JURISDICTION
    (a) The Privacy Policy & Information protection shall be governed and construed in accordance with the laws of the Socialist Republic of Vietnam.
    (b) If any part of this Privacy Policy & Information protection is determined to be invalid or unenforceable under applicable law, the invalid or unenforceable provisions will be deemed superseded by valid, enforceable provisions that most closely match the intent of the original provisions, and the remainder of this Privacy Policy & Information protection will continue in effect.
    (c) Any disputes arising out of, in respect of, or connection with this Privacy Policy & Information protection shall be settled by the competent courts of Vietnam.
